1. Acceptance of Terms

By using Shiftly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and Shiftly, operated by William Flavel (ABN 66 525 260 843), Perth, Western Australia.

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Description of Service

Shiftly is a WhatsApp-based tool that helps NDIS support workers generate progress notes and invoices from shift details provided by voice note or text message. Documents are generated using artificial intelligence and delivered as PDFs via WhatsApp.

Shiftly is a documentation assistance tool and does not provide legal, compliance, or financial advice.

3. Free Trial

New accounts receive a 14-day free trial with full access to all features. No payment information is required to start a trial.

At the end of the trial period, access to shift submission and document generation will be suspended until a subscription is activated. You may still access help and administrative commands during this time.

4. Subscription and Payment

After the free trial, Shiftly is available for $25 AUD per month (inclusive of GST where applicable). Subscriptions are billed monthly via Stripe.

6. Disclaimer — AI-Generated Documents

Progress notes and invoices are generated by artificial intelligence based on information you provide. You are responsible for reviewing all documents for accuracy and compliance before submitting them to the NDIS, a plan manager, or any other party.

Shiftly does not guarantee that generated documents will meet all NDIS requirements in every circumstance. The Service is a productivity tool, not a substitute for professional judgement.

7. Limitation of Liability

To the maximum extent permitted by law, Shiftly and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to rejected NDIS claims, compliance penalties, or data loss.

Our total liability to you for any claim arising from these terms or your use of the Service shall not exceed the amount you paid in the 3 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time if you breach these terms, misuse the Service, or engage in conduct that we determine is harmful to other users or the integrity of the NDIS.

You may terminate your account at any time by cancelling your subscription and contacting us at hello@getshiftly.com.au to request data deletion.
